Definitions

The “Client” means the person/s, organization or company booking the equipment, act or entertainment with the “Company”.

The “Company” means Photo Bomz Studio, LLC.

CONTRACT:

Payment Terms

Package Fee: The Client agrees to pay the Company the total fee for the selected booth package where both parties have agreed.

Add-Ons: Additional services or customizations ("Add-Ons") not included in the initial booth package may be requested by the Client. These Add-ons will incur additional fees.

Customized Products: Should the Client request customized products not included in the initial photo booth package, such requests must be confirmed in writing (including text or email) by both the Client and the Company and will be subject to additional fees.  Event cancellation does not waive the fees for custom-ordered products, which remain due.

Deposit and Cancellation

A non-refundable deposit of the amount agreed upon is required at the time of contract signing to secure the event date. Cancellations must be made within three business days from the booking date to avoid penalties. 

Balance and Payment

The due balance must be fully paid and cleared at least 14 days before the event start date. Acceptable payment methods are major credit cards, Venmo or Paypal. Services will not commence until the full payment is received. Any additional hours requested or required beyond the contracted time are $100 per hour and must be paid at venue site before these additional services are provided.

Parking

The Client is responsible for all parking expenses for Photo Bomz Studio, LLC employees. Services will not be rendered until parking fees are paid unless arrangements are made prior to the event. Parking should be within a reasonable distance from the setup location.

Photo Booth Operations

The Company will endeavor to keep the photo booth operational during the specified time. However, interruptions may occur for maintenance or service adjustments. A qualified representative will be onsite to operate the booth. If the booth is non-operational during the agreed times, the Client is entitled only to a refund of the payments made and time the booth was non-operational. No consequential damages will be covered.

Photo Booth Set-Up/Tear-Down

The Company will deliver, set up, and remove the photo booth from the event location. The operation times of the photo booth may be adjusted if the event location or the client concludes the event earlier than the contracted end time; under such circumstances, no refunds will be issued. The designated setup area must be reasonably accessible and on level ground. The company requires access to the venue at least 1-2 hours prior to the event for setup and 30-45 minutes post-event for takedown.

Space and Placement Requirements

The Majestic Mirror requires approximately 8 feet by 8 feet for optimal setup for mirror, printer, and table. The Elite Bomb Shell requires a space of 6 feet by 8 feet. We will make every effort to accommodate the space available to satisfy both guests and the Client. A standard 3-prong, 110V electrical outlet must be available within 6 to 10 feet of the booth area.

Inclement Weather

The Company reserves the right to cease operations if weather conditions pose a risk to personnel, equipment, or guests. Compensation will not be affected, but credits may be issued for future events.

Liability and Indemnification

The Company is not liable for direct, indirect, incidental, or consequential damages arising from this agreement. The Client will indemnify and hold harmless the Company and its agents from any liability related to the Client's event. Legal fees from third-party claims will be borne by the Client unless the loss is due to the negligence of the Company.

Damage to Equipment

The Client is responsible for any damage or loss to the Company’s equipment caused by misuse, theft, disaster, or power issues.

Model Release

By hiring Photo Bomz Studio, the client gives the company permission to use images taken at their event to be used on Photo Bomz Studio’s website, promotions, social media pages and for advertising and promotional purposes.
We are a top-rated business that shows complete respect to all customers, clients and guests photos.

We take the privacy and safety of minors seriously. Any images of children under 18 years old will be used with care and only for the purposes agreed upon. We will not share or distribute these images without explicit parental consent. It is the responsibility of the client or event organizer to inform us if any individuals under 18 will be photographed. If it is discovered that an individual under 18 was photographed without our knowledge, we cannot be held liable if they appeared to be over 18. However, upon learning of such a situation, we will take immediate steps to ensure compliance with our privacy policy, including removing or restricting the use of the images as appropriate.

Retention of Images: We’ll keep a digital copy of your photographs for 60 days after your event, at which point they’ll be deleted permanently, so grab them while you can!

 

Final Provisions

This Agreement constitutes the entire understanding between the Client and the Company, superseding all prior discussions, negotiations, or agreements. Any amendments to this Agreement must be made in writing and signed by both parties.

Both the Terms and Conditions and this Event Service Agreement appended hereto are intended by the parties to be and shall be coextensive and of equal force and effect. In the event of any discrepancy or inconsistency between the Terms and Conditions and the Event Service Agreement, neither shall be deemed to supersede or prevail over the other. Instead, the Terms and Conditions and the Event Service Agreement shall be construed harmoniously to the extent possible, and any ambiguity or conflict shall be resolved in a manner that gives effect to the intent of both documents, as mutually agreed upon by the parties at the time of execution.
